Aeroméxico and Mexicana de Aviación were sanctioned by the Federal Economic Competition Commission Cofece, this because it was detected that they carried out monopolistic practices on 112 national air routes between 2008 and 2010.
According to the competition agency, “they engaged in absolute monopolistic practices in the market for public air transportation services for passengers originating and ending in national territory.”
For this reason, the plenary session of Cofece decided to impose a sanction of 86 million pesos on Aeroméxico, while it imposed the “minimum applicable sanction” on Mexicana de Aviación given that the company was formally declared bankrupt.
Three individuals, whose identity France Mobile Number List was not disclosed, were also fined a total of 2.2 million pesos.
It is worth mentioning that according to Cofece, between April 2008 and February 2010, both companies agreed to “coordinately establish the prices they would charge users” through “the establishment of base or minimum prices on various routes originating and ending in Mexico.”
Cofece identified 112 routes involved in this conduct, among which the most important in the country stand out, such as Mexico City-Guadalajara, Mexico City-Monterrey, Mexico City-Mérida, Mexico City-Tijuana, or Guadalajara-Puerto Vallarta. .
In those two years, airlines transported 42.1% of the total passenger traffic on domestic flights and Cofece estimated damages in the market of two thousand eight million pesos.
In the investigation that began in 2015, some representatives of the airline Aeroméxico and Mexicana de Aviación, “exchanged information on the itemized or future rates that they would charge to, based on it, define the base or minimum price for the air transportation service. ”.
“They did it through multiple emails from official and unofficial accounts,” the agency said.
With these messages they complained when any of them presented lower rates on the committed routes.
In these emails they concealed the identity of the companies, as they referred to Aeroméxico as “Mañanero” and Mexicana de Aviación as “Mediodía”, which “evidenced the intention and knowledge that they were committing punishable conduct.”
